Terms of Service

1. Acceptance

By accessing or using the N Chill Party website, account services, invitations, or browser extension (the “Service”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be at least 13 and legally able to agree to these Terms. If local law requires parental consent or a higher minimum age, that requirement applies. Provide accurate account information, keep your credentials and devices secure, and promptly tell us about suspected unauthorized use. You are responsible for activity under your account.

3. The Service and license

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for lawful, non-commercial watch parties. The Service may synchronize supported HTML5 video playback and enable communications between invited participants. Features and supported sites may change.

4. Streaming services and third parties

Each participant must obtain their own lawful access to the content and any required subscription. You must comply with the terms, geographic restrictions, and household or account-sharing rules of the streaming service you use. N Chill Party does not circumvent digital rights management, provide copyrighted programs, or authorize public performances.

N Chill Party is independent and is not sponsored by, endorsed by, or affiliated with Netflix, Hulu, YouTube, Disney+, Max, Prime Video, Peacock, or other referenced services. Their names and marks belong to their respective owners. Third-party websites, sign-in services, stores, and payment services are governed by their own terms.

5. Acceptable use

You may not use the Service to violate law or third-party rights; harass, threaten, exploit, or impersonate anyone; distribute malware or abusive content; gain unauthorized access; disrupt or overload the Service; reverse engineer except where law permits; scrape or resell data; evade limits or payment controls; or use the Service for an unauthorized public exhibition.

6. Invitations and communications

Friend and party links may connect the person who accepts the link with its sender. Share links only with people you intend to invite. Party participants can receive your username, presence, playback state, selected streaming URL, and any audio or video you enable. You are responsible for what you say, show, or share and must respect the privacy and rights of others.

7. Paid plans

Prices, plan features, billing frequency, taxes, and renewal terms are shown at checkout. If you purchase a recurring plan, you authorize Stripe to charge the payment method on file until cancellation. You may cancel using any account or Stripe-hosted method we make available or by contacting support@nchillparty.com. Cancellation takes effect at the end of the paid billing period unless applicable law requires otherwise. Fees are non-refundable except where required by law or expressly stated at purchase.

8. Ownership and feedback

N Chill Party and its licensors own the Service, including its software, design, branding, and documentation, excluding third-party content and marks. These Terms do not transfer ownership to you. If you provide feedback, you allow us to use it without restriction or compensation.

9. Privacy

Our Privacy Policy describes how we collect, use, retain, and share information, including the extension’s handling of streaming synchronization and camera or microphone data.

10. Availability and changes

The Service may be interrupted, delayed, or incompatible with a site after that site changes. We may modify, suspend, or discontinue features and impose reasonable limits. We do not guarantee that every streaming provider, browser, device, or title will remain supported.

11. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access when we reasonably believe you violated these Terms, created risk or legal exposure, failed to pay applicable fees, or used the Service abusively. Provisions that by their nature should survive termination will survive.

12. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted operation, perfect synchronization, error-free communications, or the availability or legality of third-party content. Mandatory consumer warranties remain unaffected.

13. Limitation of liability

To the fullest extent permitted by law, N Chill Party and its operators, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits or data, or third-party conduct. Our aggregate liability relating to the Service will not exceed the greater of US $100 or the amount you paid us during the 12 months before the claim. Some jurisdictions do not allow these limits, so they may not apply to you.

14. Applicable law

These Terms are governed by the laws applicable where the N Chill Party operator is established, without regard to conflict-of-law rules, except that mandatory consumer protections in your home jurisdiction continue to apply.

15. Changes and contact

We may update these Terms by posting a revised version and effective date. If a change materially affects your rights, we will provide reasonable additional notice. Questions, legal notices, and support requests may be sent to support@nchillparty.com.
